Welcome to Sheeldy
These Terms of Use (the "Terms") govern your access to and use of the Sheeldy service (the "Service") available through the website www.sheeldy.com and its mobile applications (the "Platform"). These Terms constitute a legally binding agreement between Sheeldy SAS ("Sheeldy", "we", "our") and you ("you", "your"). By creating an account, accessing or using the Service, you agree to be bound by these Terms in their entirety.
What is Sheeldy?
Sheeldy is a personal data removal and consent management service operating in compliance with the GDPR (General Data Protection Regulation). Sheeldy acts on your behalf to:
- Request the deletion of your personal data from data processing providers;
- Unsubscribe you from commercial mailing lists and advertising;
- Exercise your rights to withdraw consent and to object to the sale or sharing of your data.
Sheeldy undertakes to make all reasonable efforts to submit your deletion and unsubscription requests to the relevant providers. However, Sheeldy cannot guarantee the complete effectiveness of these requests. Despite our best efforts, you may continue to receive promotional emails, newsletters or other communications from providers or third parties. Reasons may include:
- Non-compliance with your request by the recipient;
- The complexity of technical unsubscription processes;
- The existence of multiple databases or mailing lists held by the same provider;
- Access by other parties to your email address;
- Administrative and technical processing delays.
You expressly accept this limitation by using the Sheeldy Service. The Service is provided "as is" with no guarantee of complete or definitive results.
Eligibility criteria
Sheeldy is intended for natural persons aged 18 or over residing in the European Union, Switzerland, the United Kingdom, Norway or Iceland. Minors are expressly prohibited from submitting any personal information or using the Sheeldy Service.
By accessing or using the Service, you certify and warrant that:
- you are at least eighteen (18) years of age;
- you will use the Service in accordance with these Terms and any applicable law;
- you reside in a country where the Service is available;
- you have all the rights and powers necessary to accept these Terms.
Account creation
To use the Sheeldy Service, you must create an account by providing accurate and complete information (first name, last name, email address, postal address, telephone number and date of birth). You are fully responsible for maintaining the confidentiality of your password and for any activity on your account.
You agree to notify Sheeldy immediately of any unauthorized access to your account. Sheeldy cannot be held liable for any loss resulting from unauthorized access to your account, with or without your knowledge. Sheeldy reserves the right to terminate your account at any time.
You may update the information you have provided to us at any time (except the registration email address). Sheeldy is intended for personal use only. You are authorized to create only one account. You may not sell, assign or transfer your account to another person.
Prohibited activities
When using the Sheeldy Service, you must not:
- Use the Service for purposes other than personal use or impersonate any person or entity;
- Create multiple accounts;
- Disrupt the integrity or performance of the Sheeldy Service;
- Use the Service for purposes contrary to the law;
- Breach or circumvent these Terms of Use.
You undertake to comply with all applicable laws, regulations and guidelines in connection with your use of the Service, in particular those relating to data protection and electronic communications.
Payment and subscription
The Sheeldy Service is provided by subscription only. You may choose the subscription plan, the duration of the subscription period and the payment method available at the time of purchase.
The Service automatically renews at the end of each subscription period and your chosen payment method will be charged again, unless you cancel the automatic renewal before the expiry date. You may cancel the automatic renewal at any time in your profile under the "Subscription" section or by contacting our support team.
By providing your payment information, you accept automatic renewal. Sheeldy may modify subscription rates at any time and will inform you in advance. By continuing to use the Service after the changes, you accept the new rates and terms.
Termination and billing of the monthly subscription
The Sheeldy monthly subscription, priced at €2.50 including all taxes per month, may be terminated at any time, without notice or reason, from your customer area under the "Subscription" section or by sending a request to hello@sheeldy.com.
Termination takes effect at the end of the current monthly period. In accordance with Article L. 215-1 of the French Consumer Code and the terms of this contract, any month started remains fully due and is not subject to any refund, even partial or pro rata temporis, in the event of termination during the month. Access to the Service is maintained without interruption until the last day of the paid monthly period, the date on which the account is moved to a suspended status.
From the effective date of termination, no further charge will be made to your payment method. No additional amount may be claimed from you in respect of the terminated subscription.
Refund policy
Your satisfaction is our priority. Under the annual payment offer (€20 incl. VAT/year), if you decide to no longer use the Sheeldy Service, you benefit from a thirty (30) day right of withdrawal from your initial purchase. You may request a refund one (1) time only in accordance with this 30-day guarantee.
This refund guarantee applies exclusively to the annual offer and does not extend to the monthly subscription. No refund will be considered after this 30-day period, except in the event of a serious failure by Sheeldy to provide the Service. In exceptional cases, we will review refund requests if you can demonstrate that the Service was not available or usable. Subscriptions renewed after the initial period cannot be refunded on the basis of the 30-day guarantee, unless applicable law provides otherwise.
Refunds are processed in USD and EUR according to the currency of your initial purchase. You may request a refund by contacting our support team at hello@sheeldy.com.
Limitations of liability
Sheeldy does not guarantee that deletion or unsubscription requests will be fully complied with by the recipient providers. The Service is provided "AS IS" with no guarantee of effectiveness, completeness or definitive results. Compliance with requests depends entirely on the actions of third-party recipients and is beyond Sheeldy's control.
Privacy policy
Please consult our Privacy Policy to understand how we collect and process your personal data. By using the Sheeldy Service, you implicitly accept the processing of your data in accordance with our Privacy Policy.
Intellectual property
Everything you see or read on the Sheeldy Platform is proprietary information protected by copyright or trademarks, unless otherwise indicated, and may only be used with Sheeldy's written consent. You agree to respect the intellectual property rights of others. You may not sell, resell, transfer, distribute or commercially exploit the Sheeldy Service.
Modifications to the terms
Sheeldy may modify these Terms at any time. We will inform you by indicating on the Platform the date of the last update. It is your responsibility to consult these Terms regularly. If you find these Terms unacceptable, you must immediately cease using the Service.
